Booking and session details: Information related to your photography session, including session type (maternity, newborn, kids, adult birthday, couples, engagement, vow renewal, quinceañera/sweet 16, portrait, family, or event session), preferred dates, location preferences, special requests, and any notes you provide about your session.

Payment information: Billing details processed through our third-party payment processors. We do not store full credit card numbers on our own servers.

Communications data: Records of your communications with us, including emails, text messages, voicemails, and call logs, along with any consent you provide for these communications.

Images and media: Photographs and related digital files captured during your session.

Technical and usage data: IP address, browser type, device information, pages visited, and similar data collected automatically when you use our Site.

Marketing and advertising data: Information collected through advertising platforms (such as Meta/Facebook and Google) when you interact with our ads or visit our Site, including data collected via cookies and tracking pixels.

2. How We Collect Information

Information you provide directly, such as when you complete a contact form, booking form, or questionnaire on our Site, or communicate with us by phone, text, or email.

Information collected automatically through cookies, tracking pixels, and similar technologies when you visit our Site or interact with our online ads.

Information collected through our customer relationship management and marketing automation platform, GoHighLevel, which processes contact forms, appointment scheduling, SMS and email communications, and related workflow data on our behalf.

Information collected through our payment processors, Stripe and Square, when you make a payment to us.

Information collected through advertising platforms when you click on or interact with our ads.

How We Use Information

We use the information we collect to:

Schedule, manage, and fulfill photography sessions and related services.

Communicate with you about your booking, including confirmations, reminders, rescheduling, proof galleries, and final image delivery.

Process payments and manage your account with us.

Respond to inquiries and provide customer support.

Send appointment reminders, service updates, and (where you have opted in) promotional messages about our photography services.

Comply with legal obligations and enforce our Photography Services Agreement.

We do not use your information for any purpose incompatible with the purposes described in this Policy without first notifying you and, where required, obtaining your consent.

4. SMS & Communications

When you provide your phone number and opt in through our website forms, booking forms, or in-person/verbal consent at time of booking, you may receive text messages (SMS) from Pic5 AG Photography LLC related to:

Appointment confirmations and reminders

Rescheduling and cancellation notices

Proof gallery and final image delivery notifications

Customer service and account-related communications

Promotional offers and updates about our photography services (only if you have separately opted in to marketing messages)

Message frequency may vary depending on your booking activity and communication preferences.

Message and data rates may apply based on your mobile carrier and plan.

Consent is not a condition of purchase. You are not required to opt in to SMS messaging to book or purchase any photography services from us.

Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services necessary to deliver the messages you have requested.

No mobile information will be shared with third parties or affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Opt-Out Instructions

You may opt out of receiving text messages from us at any time by replying STOP to any message you receive from us. After you reply STOP, we will send you a one-time confirmation message, and you will not receive further text messages from us unless you opt in again.

5. Data Sharing Policy

We do not sell, rent, or trade your personal information, including your name, phone number, email address, or SMS opt-in/consent data, to any third party for marketing or promotional purposes.

We may share information with the following limited categories of recipients, solely as necessary to operate our business and deliver the services you have requested:

Service providers and subcontractors who perform support functions on our behalf, such as customer service, payment processing, gallery hosting, photo editing, and album production. These providers are contractually limited to using your information only to perform services for us.

SMS aggregators and telecommunications providers strictly as necessary to transmit text messages you have opted in to receive.

Legal and safety purposes, where disclosure is required to comply with a law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Pic5 AG Photography LLC, our clients, or others.

Business transfers, in the event of a merger, acquisition, or sale of all or a portion of our business assets, in which case client information may be transferred as part of that transaction, subject to the same privacy protections described in this Policy.

We reiterate the following commitments:

Customer opt-in data is never sold, rented, or shared with third parties for marketing or promotional purposes.

SMS consent and originator opt-in data are never shared with affiliates or third parties, except for the SMS aggregators and platform providers strictly necessary to deliver your requested messages.

While we take reasonable steps to protect your information, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Data Retention

DWe retain personal information for as long as necessary to fulfill the purposes described in this Policy, including:

Booking and communication records, for as long as needed to provide services and respond to inquiries, and as required to comply with our legal and accounting obligations.

Digital photography files, which are archived for up to three (3) months following your session, consistent with our Photography Services Agreement. After this period, we are not responsible for the retention or recovery of digital files, and clients are encouraged to download and back up their own copies promptly.

SMS and communications consent records, retained as needed to demonstrate compliance with applicable telecommunications regulations.

When information is no longer needed, we take reasonable steps to delete or anonymize it.

9. Third-Party Services

We use the following third-party platforms to operate our business and deliver services to you:

GoHighLevel serves as our primary customer relationship management (CRM), funnel builder, automation, and communications platform. GoHighLevel acts as a data processor on our behalf and stores contact information, form submissions, appointment scheduling data, and SMS/email communication records. GoHighLevel enables us to send text messages, emails, and manage appointment scheduling and call tracking.

Stripe and Square process payments made for our photography services.

Pixieset is used to deliver online proof and gallery previews of your images.

We require that our third-party service providers maintain appropriate confidentiality and security protections for any personal information they process on our behalf, and we limit their use of your information to the services they provide to us.

10. Your Rights & Choices

Depending on your location, you may have the right to:

Request access to the personal information we hold about you

Request correction of inaccurate or incomplete information

Request deletion of your personal information, subject to our legitimate business and legal retention needs

Opt out of marketing communications (SMS and/or email) at any time

Withdraw consent for non-essential cookies and tracking technologies

To exercise any of these rights, please contact us using the information in Section 13 below. We will respond to verified requests within a reasonable timeframe and in accordance with applicable law.

For cookies and tracking: Adjust your browser settings to block or delete cookies, or use available opt-out tools provided by advertising platforms such as Meta and Google.

Please note that opting out of marketing communications does not affect transactional or service-related messages necessary to fulfill an existing booking (such as appointment reminders or image delivery notifications), unless you request to stop all communications entirely.

12. Children's Information

Our Site and services are intended for use by adults. We do not knowingly collect personal information directly from children under the age of 13 through our Site.

Where a session involves photography of a minor, all booking information, consents, and communications are provided by the minor's parent or legal guardian, who is responsible for authorizing the session, image usage, and any related communications on the minor's behalf, consistent with our Photography Services Agreement. If we become aware that we have inadvertently collected personal information directly from a child without appropriate parental consent, we will take steps to delete that information.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or applicable law. Any changes will be posted on this page with an updated "Last Updated" date. We encourage you to review this Policy periodically. Continued use of our Site or services after changes are posted constitutes acceptance of the updated Policy.

14. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Florida.

Venue for any dispute shall be St. Lucie County, Florida.
