By accessing our website or booking our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida.

You agree that any legal action arising out of or relating to these terms shall be filed only in the state or federal courts located in St. Lucie County, Florida.

2. SMS & Mobile Communication

By providing your phone number on our website or during the booking process, you provide express written consent to receive automated text messages (SMS/MMS) from Pic5 AG Photography LLC.

Purpose: Messages may include appointment reminders, session updates, gallery delivery notifications, and occasional promotional offers.

Frequency: Message frequency varies.

Rates: Standard message and data rates may apply.

Opt-Out: You may opt-out at any time by replying STOP to any message. For assistance, reply HELP.

Privacy: Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

3. Intellectual Property & Copyright

All images, text, and content on this website are the property of Pic5 AG Photography LLC.

Ownership: Per U.S. Copyright Law, the Photographer retains all copyrights to images taken during sessions unless a written buyout is executed.

Usage License: Clients are granted a limited, personal-use license to print and share images. Commercial use, resale, or unauthorized alteration of images is strictly prohibited.

4. Payments, Cancellations & Rescheduling

Retainer: A non-refundable retainer may be required to secure your session date in Port Saint Lucie or surrounding areas.

Cancellations: Cancellations made less than [48 hours/7 days] prior to the session may result in forfeiture of the retainer.

Force Majeure: Neither party shall be liable for failure to perform due to "Acts of God," including extreme Florida weather (hurricanes/tropical storms) or equipment failure beyond the Photographer's control.

5. Limitation of Liability

To the maximum extent permitted by Florida law,Pic5 AG Photography LLC shall not be liable for any indirect, incidental, or consequential damages.

Our total liability for any claim arising out of our services is limited to the total amount paid by the Client for those services.
