These Terms of Service ("Terms") govern your access to and use of the website https://pic5agphotography.com (the "Site") and the photography services offered by Pic5 AG Photography LLC ("Pic5 AG Photography," "the Company," "we," "us," or "our"). These Terms apply to all visitors, clients, and users of our Site and services.

1. Agreement to Terms

By accessing our Site, submitting a form, booking a session, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

If you book a photography session with us, your booking is also governed by our separate Photography Services Agreement, which you will review and sign at the time of booking. Where these Terms and the Photography Services Agreement address the same subject matter, the Photography Services Agreement controls for matters specific to your individual session (such as retainers, rescheduling, image delivery timelines, and usage rights), while these Terms govern your general use of our Site and communications systems.

2. Description of Services

Pic5 AG Photography LLC provides professional photography services, including maternity, newborn, kids, adult birthday, couples, engagement, vow renewal, and quinceañera/sweet 16 sessions, as well as general portrait, family, and event photography. Sessions are offered both in-studio and on-location.

We use GoHighLevel as our customer relationship management (CRM), funnel, automation, and communications platform. Through this system, you may receive communications from us by email, phone call, voicemail, and SMS text message related to your inquiry, booking, or session. SMS communications are sent only to individuals who have provided consent to receive them, as described in Section 5 below.

3. User Responsibilities

When using our Site or services, you agree to:

Provide accurate, current, and complete information when submitting forms, booking sessions, or communicating with us.
Maintain the confidentiality of any account credentials, if applicable, and notify us promptly of any unauthorized use.
Cooperate in good faith regarding your photography session, including wardrobe, preparation, punctuality, and timely communication of special requests, consistent with the Photography Services Agreement.
Use our Site and services only for lawful purposes.

4. Acceptable Use

You agree not to:

Use our Site or services for any unlawful, fraudulent, or harmful purpose.
Attempt to gain unauthorized access to our systems, including GoHighLevel-hosted forms, scheduling tools, or communications infrastructure.
Submit false or misleading information through any form on our Site.
Interfere with or disrupt the operation of our Site or communications systems.
Use our SMS, email, or call communications systems to harass, abuse, or spam any party, including our staff.

5. SMS Messaging Terms

We reserve the right to suspend or terminate access to our Site or services for any user who violates this section.

By providing your mobile phone number and opting in through our website forms, booking forms, or verbal/written consent at the time of booking, you agree to receive text messages (SMS) from Pic5 AG Photography LLC.

Types of messages you may receive: When you opt in, you can expect to receive appointment confirmations and reminders, rescheduling and cancellation notices, proof gallery and final image delivery notifications, customer service and account-related communications, and, only if you have separately opted in to marketing messages, promotional offers and updates about our photography services.

Message frequency: Message frequency is appointment-based. You will receive messages tied to your booking activity, such as confirmations, reminders, and delivery updates, rather than on a recurring daily or weekly schedule. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Message and data rates: As always, message and data rates may apply for any messages sent to you from us and to us from you.

Carrier liability: Carriers are not liable for delayed or undelivered messages.

Opt-out instructions: You can cancel the SMS service at any time. Just text "STOP" to +1 (786) 486-7158. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Consent is not a condition of purchase. You are not required to opt in to SMS messaging to book or purchase any photography services from us.

Privacy of your information: Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services necessary to deliver the messages you have requested. If you have any questions regarding privacy, please read our privacy policy.

6. Payments & Billing

Payments for photography services are governed by the terms set forth in our Photography Services Agreement, which you will review and sign at the time of booking. In summary:

A non-refundable retainer is due at booking to reserve your session date and time, applied toward your total session cost.
No images, products, or services will be delivered until the full balance has been paid.
Payments are processed securely through our third-party payment processors, Stripe and Square. We do not store full credit card numbers on our own servers.
Retainers are non-refundable under all circumstances, consistent with our cancellation and rescheduling policy.

7. Intellectual Property

All content on our Site, including text, graphics, logos, images, and design elements, is the property of Pic5 AG Photography LLC or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our Site content without our prior written consent.

All photographs taken during a session are copyrighted and owned by Pic5 AG Photography LLC. Clients receive a personal-use license only, as described in the Photography Services Agreement. Commercial use, resale, or publication of session images without written consent is prohibited.

8. Disclaimers

Our Site and services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of our Site, the accuracy of its content, or the results of any photography session, including specific poses, expressions, lighting, or artistic outcomes, which remain subject to the Company's professional and artistic discretion as described in the Photography Services Agreement.

We do not guarantee that our Site will be uninterrupted, secure, or error-free, or that SMS, email, or call communications will be delivered without delay, consistent with the carrier liability disclaimer in Section 5.

9. Limitation of Liability

To the fullest extent permitted by law, Pic5 AG Photography LLC's total liability for any claim arising out of or relating to our Site, services, or these Terms is limited to the total amount paid by the client for the applicable photography session. Under no circumstances shall Pic5 AG Photography LLC be liable for emotional distress, consequential, incidental, or indirect damages, including but not limited to damages arising from accidents, injuries, or incidents occurring during a session, whether conducted in our studio or at an outdoor or third-party location, except where such liability cannot be limited or excluded under applicable law.

Clients participating in on-location or outdoor sessions acknowledge that such environments may carry inherent risks (including, without limitation, weather conditions, terrain, wildlife, traffic, or third-party property conditions), and assume responsibility for their own safety and that of any minors or guests accompanying them, to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pic5 AG Photography LLC, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your violation of these Terms; your misuse of our Site, services, or communications systems; your breach of the Photography Services Agreement; or any injury, accident, or property damage arising from your conduct, or the conduct of your guests or minors under your supervision, during a photography session, whether in our studio or at an outdoor or on-location setting.

11. Termination

We reserve the right to suspend or terminate your access to our Site or services at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, or is otherwise objectionable. Termination of access to our Site does not affect any obligations under a signed Photography Services Agreement, including payment obligations and usage restrictions on delivered images.

12. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the courts of St. Lucie County, Florida.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, services, or applicable law. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of our Site or services after changes are posted constitutes acceptance of the updated Terms.
